DEKTRON Scientific Instruments Corp, hereinafter “DEK-TRONTM”. Products are warranted to be free from defects in material and workmanship, under proper use, installation, application, and maintenance in accordance with written specifications and recommendations of DEK-TRONTM, for a period of ONE YEAR FROM THE DATE OF SHIPMENT FROM DEK-TRONTM’s PLANT in Plainfield, New Jersey. DEK-TRONTM’s obligation under this warranty is limited to the repair, replacement or exchange of parts at the option and discretion of DEK-TRONTM. Repairs or replacements of any defect or defects of parts or products shall be completed at DEK-TRONTM’s plant in Plainfield, New Jersey. DEK-TRONTM shall have the right of final determination as to the existence and cause of any defect. Any shipping or transportation costs for the repair or replacement of DEK-TRONTM parts or products shall be prepaid by the Buyer. Any and all defects shall be reported in writing to DEK-TRONTM within said one year period. DEK-TRONTM is under no obligation to assume the costs of labor involved with a diagnostic evaluation of product’s problem, removal, or installation of parts.

THIS WARRANTY IS LIMITED AND SHALL NOT APPLY TO ANY EQUIPMENT THAT HAS BEEN SUBJECT TO MISUSE, NEGLET, TAMPERING OR ACCIDENT; NOR SHALL IT APPLY TO ANY EQUIPMENT THAT HAS BEEN REPAIRED OR ALTERED, IN ANY MANNER BY UNAUTHORIZED PARTIES. THIS WARRANTY IS LIMITED TO THOSE PRODUCTS MANUFACTURED BY DEK-TRON ONLY. Any associated or related equipment or accessories furnished or used by DEK-TRONTM and not of its own manufacture, is subject to the warranty of its manufacturer. This warranty is in lieu of all other warranties expressed or implied and no DEK-TRONTM representative is authorized to assume any other liability in connection with the sale of its products. In no event will DEK-TRONTM be liable for special or consequential damages as a result of any alleged breach of this warranty provision.

DEK-TRON TM’s WARRANTIES ARE VOID AND DEK-TRON ASSUMES NO RESPONSIBILITY FOR ANY RESULTING COSTS, LOSSES, OR DELAYS ARRIZING BY ACCIDENT, ACTS OF NATURE, ACTS OF GOD, TRANSPORTATION FAILURES, WAR, FIRE, STRIKES, AND OTHER CIVIL DISTRUBANCES, OR ANY OTHER CAUSES BEYOND THE CONTROL OF DEK-TRONTM.

Terms of payment are net 30 days unless otherwise stipulated in writing by an authorized representative of DEK-TRON TM. If shipment is delayed by the Buyer, then NET 30 days starts from the date of invoice, which is the same date of completion of manufacture. All transportation and shipping costs are collected unless otherwise stipulated in writing by an authorized representative of DEK-TRONTM.

No returns are accepted, unless prior written authorization has been issued by DEK-TRON To the Buyer. Electrical Parts or Accessories cannot be returned and returns are not accepted. Mechanical Parts and Mechanical Accessories maybe returned within Thirty (30) days from the purchase date; a refund if any shall determined and decided by DEK-TRONTM after inspection of conditions of the returned items. Complete Machines or Instruments maybe returned within thirty (30) days of the purchase date; a refund if any shall be determined and decided by DEK-TRONTM after inspection of conditions of the returned goods. To return the goods, the Buyer must contact DEK-TRONTM in writing within the allowed thirty (30) days period to inform DEK-TRONTM about the intentions to return the purchased goods and to request from DEK-TRONTM a written authorization to return. No goods shall be returned without a written authorization from DEK-TRONTM to the Buyer. The date of Purchase is considered to be the date of Shipment from DEK-TRON TM ’s location. All related freight and office costs shall be the responsibility of the Buyer and shall be paid by the Buyer.

In the event of cancellation of an order for any reason, DEK-TRONTM shall be entitled to demand and receive (15% ) of the purchase price, plus the cost of all materials purchased and work finished for such equipment up to the time of cancellation. Buyer’s Notice of Cancellation must be in writing and received by DEK-TRONTM. Notice of receipt by DEK-TRONTM of Buyer’s Notice of Cancellation is the responsibility of the Buyer.

Equipment installation and start-up shall be at the expense of the Buyer, unless otherwise stipulated in writing by an authorized representative of DEK-TRONTM. Proper performance and operation of DEK-TRONTM products and equipment is guaranteed so long as operation is made pursuance to published DEK-TRONTM specifications found in DEK-TRONTM’s operating manuals or communicated directly by an authorized DEK-TRONTM representative.
